Section 1.3(d).                                                                          [Revised – modified (i) and added (ii)]
                                                                                                     [Not yet adopted pending re-notice]

(i) No item within the fenced area may extend above the completed height of the fence or be visible from outside the fenced area. This includes sheds, play structures, and other recreational activities.
(ii) Notwithstanding section d(i), upon written application the Board may approve specific items on a part time, seasonal or permanent basis that extend no higher than 48" and that otherwise comply with the Declaration and Rules. This section d(ii) is adopted on a temporary basis [effective January 01, 2022] and the Board reserves the right to (1) condition any such grants, (2) refuse to process applications, or (3) to revoke, condition, or modify permissions previously granted at any time when, in the Board’s opinion, it is either appropriate or necessary or desirable for the long term best interests of the Association or to comply with the restrictions and requirements described in section d(iii) below. Grant of an application therefore grants no right of reliance, and improvements of expenditures made are at the sole risk of the Unit Owner. In implementing this section, it is understood that similar applications may receive differing treatment. No new applications will be accepted after January 1, 2025 unless further Board action is taken to extend this temporary rule.
(iii) Any item constructed within the fenced area must be neither a visual nor sound “nuisance” and comply with reasonable standards of acceptable curb appeal and safety; and all items within the fence area must be adequately maintained at all times.

Section 1.17.  Application Procedures.                                              [NEW FOR NEXT BOARD MEETING]
                                                                                                                   [needs re-notice]

Wherever herein an applicant, application or approval is referenced—and except as otherwise provided in Section 1.3—then a Unit Owner must submit a packet to the Association manager for consideration by the Board and must receive consent in writing per Section 9.1.
[this proposed Section 1.17 clarifies Section 1.12 and Section 1.15 obligations]
